1 national, and international significance to be coordinated, 2 scheduled, and facilitated by a governmental unit, drawing on 3 the resources of public, private, civic, and other organiza4 tions for planning and implementation, to insure that the 5 appropriate observances take place.

SEC. 2. (a) There is hereby established an independent 7 establishment to be known as the American Revolution Bi8 centennial Administration (hereinafter referred to as the 9 "Administration") to coordinate, to facilitate, and to aid in 10 the scheduling of events, activities, and projects of local, State, 11 national, and international significance sponsored by both 12 governmental and nongovernmental entities in commemora13 tion of the American Revolution Bicentennial. 14 (b) The Administration shall be headed by an Adminis15 trator (hereafter referred to as the "Administrator") who 16 shall be appointed by the President, by and with the 17 advice and consent of the Senate. The Administrator shall 18 serve at the pleasure of the President and shall be com19 pensated at the rate now or hereafter prescribed for offices 20 or positions at level III of the Executive Schedule.

(c) The Administrator shall appoint a Deputy Ad22 ministrator who shall be compensated at the rate now or 23 hereafter prescribed for offices or positions at level IV of 24 the Executive Schedule. The Deputy Administrator shall 25 perform such duties as the Administrator may prescribe.

1 The Deputy Administrator shall act for and perform the 2 functions of the Administrator during any absence or dis

3 ability of the Administrator or during a vacancy in the 4 office of the Administrator.

5 (d) The Administrator shall have power to appoint and 6 fix the compensation of such personnel as he deems advisable. 7 Not more than five of such personnel may be appointed, 8 compensated, or removed without regard to the civil service 9 laws and regulations and chapter 51 and subchapter III, 10 of chapter 53, of title 5, United States Code. Their positions 11 shall be in addition to those otherwise authorized by law, 12 including those authorized by section 5108, of title 5, United 13 States Code, and they shall be compensated at a rate not 14 to exceed that now or hereafter prescribed for GS-18 of the 15 General Schedule. The Administrator shall have power to 16 appoint such advisory committees as he deems necessary. 17

(e) The Administrator may procure services as author18 ized by section 3109, of the title 5, United States Code. 19 (f) The Administrator, to such extent as he deems 20 necessary, may procure supplies, services, and property; 21 make contracts; expend funds appropriated, donated, or 22 received in pursuance of contracts hereunder in furtherance 23 of the purposes of this Act; and exercise those powers that are necessary to enable him to carry out efficiently and in 25 the public interest the purposes of this Act.

1 (g) Financial and administrative services (including 2 those related to budgeting, accounting, financial reporting, 3 personnel and procurement) shall be provided the Admin4 istration by the Department of the Interior, for which 5 payment shall be made in advance, or by reimbursement, 6 from funds of the Administration in such amounts as may 7 be agreed upon by the Administrator and the Secretary 8 of the Interior: Provided, That the regulations of the De9 partment of the Interior for the collection of indebtedness of 10 personnel resulting from erroneous payments made to or on behalf of an Administration employee, and regulations 12 of said Secretary for the administrative control of funds (31 U.S.C. 665 (g)) shall apply to appropriations of 14 the Administration: And provided further, That the Ad15 ministrator shall not be required to prescribe such regu16 lations.

17 (h) Any property acquired by the Administration 18 and which remains upon its termination shall be disposed 19 of as excess or surplus property as otherwise provided by 20 law.

21 (i) Whoever, except as authorized under rules and 22 regulations issued by the Administrator, knowingly manu23 factures, reproduces, or uses any logos, symbols, or marks 24 originated under authority of and certified by the Admin25 istrator for use in connection with the commemoration

of the American Revolution Bicentennial, or any facsimile 2 thereof, or holds out to the public objects in such a manner 3 as to suggest any such logos, symbols, or marks, shall be 4 fined not more than $250 or imprisoned not more than six 5 months or both: Provided, That this section shall be ap6 plicable upon publication in the Federal Register of noti7 fication of certification hereunder by the Administrator with 8 respect to each such logo, symbol, or mark.

SEC. 3. (a) There is hereby established an American 10 Revolution Bicentennial Advisory Board (hereinafter re11 ferred to as the "Board") to be composed of twenty-five 12 members appointed by the President. The members shall 13 serve at the pleasure of the President, and their terms of 14 office shall not extend beyond the termination date of the 15 Administration. Members of the Board shall be chosen from 16 private life and shall be broadly representative of the Na17 tion's people. In appointing persons to the Board, the Presi18 dent shall give due consideration to the contributions, among 19 others, of the Nation's youth, elders, racial and ethnic mi20 norities, artists and craftsmen, and learned professions. The 21 Administrator shall serve as an ex officio member of the 22 Board and shall act as Chairman. The Board shall meet at 23 the call of the Chairman and shall render advice to the Ad24 ministrator on all matters relating to the purposes of this 25 Act.

1 (b) Vacancies on the Board shall be filled in the same 2 manner in which original appointments were made.

3 (c) The members of the Board shall receive no com4 pensation for their services as such, but shall be allowed 5 such necessary travel expenses and per diem as are author6 ized for individuals serving without pay under section 5703, 7 of title 5, United States Code.

8 SEC. 4. (a) In order to assure a balanced program for 9 the bicentennial commemoration, encompassing the themes 10 of Heritage '76, Festival USA, and Horizons '76, and in 11 furtherance of the purposes outlined in section 2 (a) of this 12 Act, the Administration as its primary function shall prepare 13 the master calendar of events of local, State, national, and 14 international significance which will take place between July 15 1975 and September 1976. In carrying out the purposes of 16 this subsection, the Administrator shall—

(1) provide for the bicentennial master calendar or register of programs and projects, and in other ways

provide a central clearinghouse for information and coordination regarding dates, events, places, documents, artifacts, and personalities of bicentennial historical and commemorative significance;

(2) coordinate, facilitate, and aid in the scheduling

of events, programs, and projects of States and private
