PROMOTION OF PEACE ARBITRATION, CONCILIATION, AND JUDICIAL ANTI-WAR TREATY OF NONAGGRESSION AND CONCILIATION 1 Mexico The Argentine Ambassador informed the Secretary of State by a note dated February 21, 1936, that the instrument of ratification by Mexico of the anti-war treaty of nonaggression and conciliation signed at Rio de Janeiro October 10, 1933, was deposited with the Argentine Foreign Office February 17, 1936. The American Ambassador to Argentina transmitted to the Secretary of State with a despatch dated February 7, 1936, a statement received by him from the Argentine Foreign Office dated February 5, 1936, listing the countries which have deposited instruments of ratification of and instruments of adherence to the anti-war pact. The information is given as follows: The Secretary General of the Permanent Court of Arbitration informed the Secretary of State by a communication dated January 27, 1936, that the Government of Peru has appointed Mr. Alberto Ulloa S., Doctor of Laws, as member of the Permanent Court of Arbitration to replace Mr. Hernán Velarde, deceased. PERMANENT COURT OF INTERNATIONAL JUSTICE 2 PROTOCOL CONCERNING THE REVISION OF THE STATUTE OF THE PERMANENT COURT OF INTERNATIONAL JUSTICE The Secretary General of the League of Nations informed the Secretary of State by a communication dated February 3, 1936, of the entry into force of the protocol of September 14, 1929, concerning the revision of the Statute of the Permanent Court of International Justice. The notice is as follows: "In accordance with the resolution adopted by the Assembly of the League of Nations on September 27th, 1935, regarding the entry into force of the Protocol of September 14th, 1929, concerning the revision of the Statute of the Permanent Court of International Justice, and in accordance with the report on this subject which was adopted by the Council of the League of Nations on January 23rd, 1936, I have the honour, by the direction and in the name of the Council, to notify you that the conditions laid down in the Assembly's resolution having been fulfilled, the said Protocol entered into force on February 1st, 1936." Argentina The Secretary General of the League of Nations informed the Secretary of State by a circular letter dated January 21, 1936, that the Permanent Delegate of the Argentine Republic to the League of Nations signed on behalf of his Government on December 28, 1935, the protocol of signature concerning the Statute of the Permanent Court of International Justice signed at Geneva December 16, 1920, and the protocol concerning the revision of the Statute of the Permanent Court of International Justice signed September 14, 1929. ARTICLE 36 OF THE STATUTE OF THE PERMANENT COURT OF INTERNATIONAL JUSTICE 3 Argentina By the above-mentioned circular letter the Secretary General of the League of Nations also informed the Secretary of State that the Argentine delegate signed on December 28, 1935, the optional clause provided in the protocol of signature of the Statute of the Permanent Court of International Justice, and made the following declaration : "On behalf of the Argentine Republic, subject to ratification by the National Congress, I recognize as compulsory ipso facto and without special convention in relation to any other Member or State accepting the same obligation, that is to say on condition of reciprocity, the jurisdiction of the Permanent Court of International Justice, in conformity with Article 36, paragraph 2, of the Statute of the Court, for a period of ten years from the date of the deposit of the instrument of ratification, in any dispute arising after the ratification of the present declaration with regard to situations or facts subsequent to this ratification, except in cases where the Parties have agreed or shall agree to have recourse to another method of pacific settlement. "The present declaration does not apply: "1) to questions already settled; "2) to questions which, by international law, fall within the local jurisdiction or the constitutional regime of each State." CHAMBER FOR SUMMARY PROCEDURE The following letter concerning the composition of the Chamber for Summary Procedure of the Permanent Court of International Justice for the year 1936 was addressed to the Secretary of State by the Registrar of the Court February 10, 1936: "In my letter of December 2nd, 1935, I informed you of the names of the members of the Permanent Court of International Justice who had on that date been appointed by the Court to form the Chamber for Summary Procedure for the year 1936. "This election was carried out in accordance with the terms of the Statute of the Court as then in force, that is to say, the Statute in the form in which it was annexed to the Protocol signed at Geneva on December 16th, 1920. On February 1st, 1936, however, the amendments to this Statute which are annexed to the Protocol signed at Geneva on September 14th, 1929, came into force (Resolution of the Assembly of the League of Nations dated September 27th, 1935; Report adopted by the Council of the League of Nations on January 23rd, 1936; letter dated February 1st, 1936, from the Secretary-General of the League of Nations to the Registrar of the Court giving notice, by order and on behalf of the Council, of the entry into force of the amendments). One of these amendments affects Article 29 which concerns the composition of the Chamber for Summary Procedure and its effect is to increase from three to five the number of members of this Chamber. "In these circumstances, the Court, on February 6th, 1936, held a new election in order to designate those of its members who would, as from this date and until the end of the year 1936, form the Chamber for Summary Procedure as henceforth constituted.
