SEC. 2. Section 501(2) of the Lead Based Paint Poi5 soning Prevention Aet is amended by striking out “1 per 6 centum lead by weight" and inserting in lieu thereof "0.06 7 per centum lead by weight".

SEC. 3. (a) Section 503 (a) of the Lead Based Paint 9 Poisoning Prevention Act is amended (1) by striking out 10 the word "and" and inserting in lieu thereof a comma, and 11 (2) by inserting before the period a comma and the fol12 lowing: "and $20,000,000 for each fiscal year thereafter". 13 (b) Section 503(b) of such Act is amended (1) by 14 striking out the word "and" and inserting in lieu thereof a 15 comma, and (2) by inserting before the period a comma 16 and the following: "and $25,000,000 for each fiscal year 17 thereafter".

(e) Section 503(e) of such Aet is amended (1) by 19 striking out the word "and" and by inserting in lieu thereof

a comma, and (2) by inserting before the period a comma 21 and the following: "and $5,000,000 for each fiscal year

22 thereafter".

(d) Section 503(d) of such Act is amended by striking out all matter after the semicolon and inserting in lieu

25 thereof "any amounts authorized for one fiseal year but not

1 appropriated may be appropriated for the succeeding fiscal

2 year,".

3 That (a) section 101(a) of the Lead Based Paint Poisoning 4 Prevention Act is amended by striking out “units of general 5 local government in any State" and inserting in lieu thereof 6 "public agencies of units of general local government of any 7 State and to private nonprofit organizations in any State". (b) Section 101 (b) of such Act is amended by striking 9 out "75 per centum" and inserting in lieu thereof “90 per 10 centum".

(c) Section 101 of such Act is amended by adding at the 12 end thereof the following new subsection:

"(e) The Secretary is also authorized to make grants to 14 State agencies for the purpose of establishing centralized 15 laboratory facilities for analyzing biological and environ16 mental lead specimens obtained from local lead based paint 17 poisoning detection programs.".

(d) Section 101 of such Act is further amended by add19 ing at the end thereof the following new subsection:

20

"(f) No grant may be made under this section unless the 21 Secretary determines that there is satisfactory assurance that 22 (A) the services to be provided will constitute an addition to, 23 or a significant improvement in quality (as determined in 24 accordance with criteria of the Secretary) in, services that 25 would otherwise be provided, and (B) Federal funds made

1 available under this section for any period will be so used as 2 to supplement and, to the extent practical, increase the level 3 of State, local, and other non-Federal funds that would in 4 the absence of such Federal funds be made available for the

program described in this section, and will in no event sup6 plant such State, local, and other non-Federal funds.".

SEC. 2. (a) Section 201 of the Lead Based Paint 8 Poisoning Prevention Act is amended by striking out “units of general local government in any State" and inserting in 10 lieu thereof "public agencies of units in general local govern11 ment in any State and to private nonprofit organizations in any State".

(b) Section 201(a)(2) of such Act is amended to read

as follows:

"(2) the development and carrying out of procedures to remove from exposure to young children all interior surfaces of residential housing, porches, and ex

terior surfaces of such housing to which children may be

commonly exposed, in those areas that present a high risk for the health of residents because of the presence of lead

based paints. Such programs should include those sur

faces on which nonlead based paints have been used to

cover surfaces to which lead based paints were previously applied; and".

(c) Section 201 of such Act is amended by adding at

the end thereof the following new subsection:

1 "(c) Any public agency of a unit of local government

or private nonprofit organization which receives assistance 3 under this Aet shall make available to the Secretary and the 4 Comptroller General of the United States, or any of their 5 duly authorized representatives, for purposes of audit and 6 examination, any books, documents, papers, and records that are pertinent to the assistance received by such public agency 8 of a unit of local government or private nonprofit organiza9 tion under this Act."

SEC. 3. Section 301 of the Lead Based Paint Poisoning 11 Prevention Act is amended to read as follows:

"FEDERAL DEMONSTRATION AND RESEARCH PROGRAM

"SEC. 301. (a) The Secretary of Housing and Urban 14 Development, in consultation with the Secretary of Health, 15 Education, and Welfare, shall develop and carry out a

16

demonstration and research program to determine the nature 17 and extent of the problem of lead based paint poisoning in 18 the United States, particularly in urban areas, including the 19 methods by which the lead based paint hazard can most effec20 tively be removed from interior surfaces, porches, and exte21 rior surfaces of residential housing to which children may be 22 exposed.

"(b) The Secretary of Health, Education, and Welfare 24 shall conduct appropriate research on multiple layers of 25 dried paint film, containing the various lead compounds comS. 3080- -2

monly used, in order to ascertain the safe level of lead in 2 residential paint products. Within eight months after the date

of enactment of this Act, the Secretary shall submit to Con4 gress a full and complete report of his findings and recom5 mendations as developed pursuant to such programs, together 6 with a statement of any legislation which should be enacted or any changes in existing law which should be made in order 8 to carry out such recommendations."

SEC. 4. Section 401 of the Lead Based Paint Poison10 ing Prevention Act is amended to read as follows:

11 "PROHIBITION AGAINST USE OF LEAD BASED PAINT IN

CONSTRUCTION OF FACILITIES AND THE MANUFAC

"SEC. 401. The Secretary of Health, Education, and

15 Welfare shall take such steps and impose such conditions

as may be necessary or appropriate

"(1) to prohibit the use of lead based paint in residential structures constructed or rehabilitated by the Federal Government, or with Federal assistance in

any form, after the date of enactment of this Act, and "(2) to prohibit the application of lead based

paint to any toy, furniture, cooking utensil, drinking

utensil, or eating utensil manufactured and distributed

after the date of enactment of this Act."

SEC. 5. (a) Effective after December 31, 1972, section
