NOMINATIONS

The committee met, pursuant to recess, at 10:10 a.m. in room SD-106, Dirksen Senate Office Building, Senator John Warner (chairman of the committee) presiding.

Chairman WARNER. There is a very unusual list of promotions before this committee at this time, including the elevation of Brig. Gen. Robert L. Halverson to be Major General of the National

Guard, and accompanying that a series of others to be elevated to the rank of brigadier general.

I mention that because you, Mr. Secretary, have designated General Halverson of the National Guard to be the commanding officer of our troops in Kosovo, am I not correct on that, and to take on that responsibility he should have his second star, which he has deservedly earned through the years.

So at this time, a quorum being present, we are ready to consider 18 pending military nominations which appear on the list that has been passed out to each member. These nominations have been before the committee the required length of time. The chair knows of no objection, nor does the distinguished ranking member, that have been raised by any of our members.

Consequently, is there a motion to favorably report these 18 military nominations to the Senate as a whole.

Senator LEVIN. So moved.

Chairman WARNER. Seconded.

Senator SESSIONS. Second.

Chairman WARNER. All in favor say aye. [A chorus of ayes.]
Chairman WARNER. Thank you, Mr. Secretary.

OPENING STATEMENT OF SENATOR JOHN WARNER,

CHAIRMAN

Chairman WARNER. Good morning, everybody. I apologize for my tardiness. The committee meets today to receive testimony concerning two very important nominations.

Mr. Rudy de Leon has been nominated to be the Deputy Secretary of Defense and Mr. Douglas Dworkin has been nominated to be General Counsel for the Department of Defense, subject to the material produced in the course of our review process.

It is my intention, however, to support these two nominations very strongly. I commend the Secretary of Defense and the President for submitting these nominations to the Senate.

Secretary de Leon, we are very familiar with you. I have a picture in my office of you, Les Aspen and Sam Nunn, thrashing away at a conference somewhere. You were the Rasputin of those days. [Laughter.]

You have had many years of distinguished service, both in the legislative branch and in the executive branch, and you are well qualified to take on this very serious responsibility.

We would be remiss to not reflect on the services of Dr. Hamre, soon to be departed, when you are confirmed by the Senate. He has, beyond all expectations, served in great distinction to this nation in that position, and we anticipate that you will do the same. You accompanied your old friend, Les Aspen, to the Department of Defense, serving as his special assistant, continued to do service as the Undersecretary of the Air Force, Undersecretary of Defense for Personnel and Readiness.

You have this long record of service. I have found you to be a man of intellect and integrity. I look forward to working with you, subject to the confirmation of the Senate.

Mr. Dworkin, you have an impressive record as well. You were a partner in the law firm of Arnold and Porter before joining the Department of Defense, as the Principal Deputy General Counsel in January of 1998. He has been Acting General Counsel since November of 1999.

You also have considerable experience in the State Department as a Foreign Service Officer, and as the Executive assistant to Secretary Warren Christopher. So you bring your own independent extraordinary set of credentials to this important post.

Secretary de Leon, I understand your wife Ann and your oldest daughter Libby are here with you today. Would you kindly introduce them, please?

Secretary DE LEON. I ask my wife, Ann, and daughter, Libby, to stand. We have another daughter, about to turn 3 years old, who is at nursery school this morning

Chairman WARNER. That is wonderful.

Secretary DE LEON.-who is with us in spirit.

Chairman WARNER. Libby, you can take off your coat. We are going to be here a while. [Laughter.]

So just relax.

Mr. Dworkin, I understand that your wife, Marcia, and your daughters, Emily and Rebecca, are here today. Would you kindly introduce them?

Mr. DWORKIN. I would be very happy to, if they would stand up. My wife Marcia, and my daughter Rebecca, and my daughter Emily. Emily is home from college now, and Rebecca is a student at Walt Whitman High School, in Bethesda.

Chairman WARNER. We are delighted that you are here. It is very important that the families come and join these hearings. You may be seated now. Thank you.
