U.S. District Court. The records of the Nashville division, with which are interfiled records of the former circuit court for this district and of the former U.S. district courts for the districts of Tennessee and western Tennessee, include records in criminal and civil, 1799-1861, mixed civil, 1842-97, bankruptcy, 18981943, civil action, 1938-43, criminal, 1873-1943, equity, 1913-38, and law, 1907-38, cases; and book records in bankruptcy, civil action, criminal, equity, and law matters, 1797-1943, including book records of the U.S. circuit court for this district, ca. 1865-99 and 190911. There are similar records for divisions at Columbia, 1925-43, Cookeville, 1909-43, and Winchester, 1925-41.

Confederate States District Court for the Middle District of Tennessee. The records consist of case papers, 1862-65.

TENNESSEE, WESTERN DISTRICT. 1864-1944. 1,649 lin. ft. (in FRC Atlanta).

US. District Court. The records of this court, with which are interfiled records, 1864-1911, of the former circuit court for this district, were created by divisions at Memphis and Jackson. Those of the Memphis division include records of bankruptcy, 1868-1944, civil action, 1938-44, criminal, 1865-1944, and equity and law, 1864-1938, cases; and book records of bankruptcy, criminal, equity, and law matters, 1864-1940. There are similar records for the division at Jackson, 1879-1944.

TEXAS, WESTERN DISTRICT. 1879-1945. 619 lin. ft. (in FRC Fort Worth).

US. District Court. The records are those of the San Antonio division relating to bankruptcy, 1898-1945, criminal, 1879-1944, equity, 1879-1938, and law,

1886-1938, cases; and book records of bankruptcy and other matters, 18791944.

US. Circuit Court. The records consist of the San Antonio division's law cases, 1879-1912.

The records (in FRC Boston) include dockets, 18011906; general, 1792-1841, criminal, 190645, and civil, 1906-45, case files; copyright books, 1793-1830; title pages submitted for copyright, 1821-42; bankruptcy records, including dockets, 1842-1906, assignments, 1867-78, and case files, 1867-1945; cashbooks, 1834-52; declarations of intentions for naturalization, 1859-1917; dockets of Judge Hoyt H. Wheeler, 1877-1900; minutes, 1841-1902; and records of U.S. commissioners, 1872-1945. Also included are records (2 lin. ft., in WNRC) consisting of population census schedules for the 1830 and 1840 censuses in Vermont.

US. Circuit Court. The records (in FRC Boston) include dockets, 17921906; criminal, 1859-1912, civil, 18701912, and equity, 1871-1911, case files; and an order book, 1882-1911.

VIRGINIA, EASTERN DISTRICT. 1795-1913. 337 lin. ft. (in WNRC).

The National Archives holds only a portion of the records of this court and its predecessors. Many of their records, notably the pre-Civil War records of the circuit court, are in the Virginia State Library.

US. District Court. The records consist of minutes of proceedings held at Richmond, Alexandria, and Norfolk, 1865-90; dockets of confiscation, admiralty, and chancery cases, 1864-65 and 1873-99; confiscation records, 1863-65; admiralty case files and related records, 1866-98; records created under the Second and Third National Bankruptcy Acts, 1842-43 and 1867-85; criminal case files, 1878-92, and a criminal docket,

1913; equity (chancery) case files in cases that arose from bankruptcy proceedings, 1868-84; an election supervision docket, 1868-94; habeas corpus case files, 1870-98; law case files, 1867-98; and law cases relating to internal revenue matters, 1867-96. Other records include declarations, petitions, and certificates of naturalization, 1855 and 1867-96; correspondence of the clerk, 1855-89 and 1898-1901; lists of jurors, 1866-74 and 1889-90; and case files and dockets of U.S. commissioners, 1867-73 and 1896-97.

US. Circuit Court. The records consist of minutes of proceedings held at Norfolk and Richmond, 1866-68; a law, bankruptcy, and equity docket, 1876-97; case files in bankruptcy cases appealed from the district court, 1868-77; error and appeal case files, 1867-78; photostatic copies of records of the Aaron Burr treason trial, 1807; criminal, 1867-93, equity, 1866-78 and 1893-1910, habeas corpus, 1868-82, and law, 1866-1911, case files; a law docket, 1866-99; an equity docket, 1866-1901; debtors writs, 17951840; and records concerning supervision of elections, 1870-94.

VIRGINIA, WESTERN DISTRICT. 1819-1942. 80 lin. ft. (in WNRC).

U.S. District Court. Records of the "old" court, which sat at Wytheville from 1819 to 1861, consist of criminal, 181961, equity, 1819-56, and law, 1820-59, case files; and appointment papers and other records of the office of the clerk, 1819-61.

Records of the "new" court, created by an act of February 3, 1871, consist of a grand jury docket, 1889-90, and other dockets, 1880-88 and 1900-1906; miscellaneous case papers, 1871-1930; civil case files, 1872-91 and 1913-29; criminal case files, 1871-1922; records created under the Third National Bankruptcy Act, 1868-85; naturalization records, 1907-17; and records of the U.S. commissioner, consisting of case files,

1889-1927, and other records, 1875-1928. Records of the office of the clerk consist chiefly of correspondence, 18711936, records relating to executions, 1871-1909, writs of capias and venire facias, 1875-1934, rules of court, 18191942, accounting records, 1874-1927, and appointment papers, 1859-1919.

US. Circuit Court. Records of this court, which sat at Abingdon, consist of dockets, 1880-94 and 1907; and equity, 1871-88, law, 1871-1903, and civil (in which equity, law, and habeas corpus cases were combined), 1879-1911, case files.

Confederate States District Court for the Western District of Virginia. Records of this court, which held sessions at Staunton, Lexington, and Wytheville, include sequestration case papers, 1861-64, and a common law and chancery docket, 1861-63 (entered in an "Issue Docket" of the U.S. district court).

The records of the Cheyenne division include records in bankruptcy, 1899-1943, civil, 1888-1943, and criminal, 1890-1943, cases; book records, 1895-1949; and records of U.S. commissioners, 1894-1943. There are similar records for divisions at Evanston, 1892-1923, Lander, 1911-23, and Sheridan, 1910-20.

RECORDS OF THE UNITED STATES COURT OF CLAIMS (RECORD GROUP 123)

The U. S. Court of Claims was established by an act of February 24, 1855, to hear claims against the United States based on any law of the Congress, regulation of an executive department, or contract with the Government, express

or implied, including all claims referred to the court by the Congress. Under this act the court was only a factfinding agency, and its conclusions were submitted to the Congress for approval and the granting of awards. In 1863 the Con

gress enlarged the court's jurisdiction and gave it authority to render judgments against the Government, with the right of appeal to the Supreme Court. An act of 1925 abolished appeals from the Court of Claims to the Supreme Court and substituted writs of certiorari.

Litigation before the court arises under legislation that confers either permanent or temporary jurisdiction. The court has permanent jurisdiction in general jurisdiction cases, which concern claims brought directly by claimants under general provisions of law, and in congressional and departmental cases, which concern claims referred by the Congress or by executive departments. It has had temporary jurisdiction in District of Columbia cases, French spoliation cases, and Indian depredation cases. See Court of Claims Reports (1857-1968).

There are 2,840 cubic feet of records dated between 1855 and 1952, with some dated as early as 1783, in this record group.

These are claims files based on contracts entered into by officials of the District of Columbia in the 1870's.

These concern claims for property taken or destroyed by Indians in amity with the United States, and include documents dated as early as 1812.

Case files concerning enrollment to share in an award made to Eastern Cherokees by the Court of Claims (in general jurisdiction cases 23199, 23212, and 23214), including copies of some Cherokee enrollment records dated as early as 1835.

Case files for suits brought directly by claimants under general provisions of law, chiefly involving Government contracts, war service, war property damage, losses incurred by disbursing officers, and the use and infringement of patent rights.

CASE FILES FOR CONGRESSIONAL CASES. 18841952. 722 lin. ft. (in WNRC).

Case files for claims referred by the Congress under the Bowman and Tucker Acts of March 3, 1883, and March 3, 1887, and under authority of section 151 of the Judicial Code of March 3, 1911, consist in large part of claims that arose out of the Civil War and other wars.

CARTOGRAPHIC RECORDS. ca. 1940-47. 194 items.

These consist of annotated aerial mosaics (photomaps), topographic maps of quadrangles, and large- and smallscale maps concerning Ute tribal lands and contiguous areas; annotated base maps prepared by the Department of the Interior, showing types of grazing and similar activities; negative photo

stats of "Range Survey Computation Summaries"; and related materials used by both claimant and defendant as exhibits in case No. 45585, Confederated Bands of the Ute Indians v. The United States. They are arranged in two groups, claimant's exhibits and defendant's exhibits. The case file itself is in WNRC.

Discontinued Agencies

RECORDS OF THE UNITED STATES COMMERCE COURT (RECORD GROUP 172)

The U. S. Commerce Court was created by the Mann-Elkins Act of June 18, 1910, as a specialized tribunal whose jurisdiction included the enforcement, suspension, or repeal, in whole or in part, of orders of the Interstate Commerce Commission and the trial of cases arising under the Interstate Commerce Act of 1887 and amendatory acts. The jurisdiction of the court had previously been invested in the Central States circuit courts; judgments of the Commerce Court were now made reviewable by the Supreme Court. The Attorney General represented the United States in all proceedings before the court. An act of October 22, 1913, abolished the court and transferred its jurisdiction and pending cases to U. S. district courts. The court's administrative books, dock

ets, files, and case papers not transferred to district courts were placed in the custody of the Department of Justice.

Records of cases pending at the time the court was abolished are among records of U. S. district courts (see RG 21).

There are 22 cubic feet of records dated between 1910 and 1913 in this record group.

These consist of a docket, a court journal, a roll of attorneys, case files, a calendar of cases, stenographic minutes and reporters' transcripts of testimony for some cases, letters sent by the marshal, and records concerning accounts and disbursements.
