It is estimated that $12,610,000 will be required to operate the U.S. marshals offices in the 1965 fiscal year. The increase of 1965 over 1964 amounts to $669,000 of which $282.100 is due to statutory requirements. The remaining $386,900 includes $100,000 for the reclassification of 200 field deputy positions and $286,900 for other operating costs, such as travel, communications, and other services.

GENERAL STATEMENT

U.S. marshals are officers under the Department of Justice but they also serve as ministerial officers of the Federal courts. They have a wide range of responsibilities in Federal law enforcement, carry out administrative assignments as directed by the Attorney General; execute lawful orders and commands of the Federal courts; serve process issued by Federal courts in behalf of the United States and private litigants; attend sessions of the district courts and courts of appeal, when so required; serve process issued by congressional committees and governmental regulatory bodies; arrest, guard, and transport Federal prisoners; seize, guard, and sell, or otherwise dispose of personal or real property pursuant to Federal court orders; and serve as disbursing officers for the Department of Justice and the U.S. courts.

The workload of the marshals' service showed an increase in fiscal 1963 as it did in fiscal 1962. This increase, which is expected to continue, is attributable to the enlargement and acceleration of court activities, and the influx of cases resulting from recent legislation expanding the scope of Federal criminal law, as well as the more vigorous efforts being exerted to enforce Federal laws, prosecute and combat organized crime and members of crime syndicates engaged in racketeering, gambling, narcotics peddling, counterfeiting, and other illegal activities. In conformity with the general departmental policy to hold employ. ment in 1965 to the 1964 level, additional positions are not being requested despite the increase in the marshals' workload, as well as the increasing demands for the marshals' services in emergency situations. Every effort will be made to absorb these increases by the presently authorized staff.

It is expected that emergency situations will continue to arise, thereby pla an added burden on manpower and increasing operating expenses. In July deputies were sent to Louisiana to render assistance in the event of an a pated disturbance during a primary election, and deputies from the Distri Columbia were sent to New York City to assist in maintaining order and sec during a trial of 14 defendants in a narcotic case. Following a shooting inc in a Federal courtroom, deputies were detailed to Tennessee to guard a jury and maintain order in the courtroom. It was necessary to send deputies into a Northern State to carry out a court order following a sho during a railway strike. Several Government witnesses and their families in protective custody and were guarded at their homes. Deputy marshal cooperation with other agencies, are performing more and more investigative surveillance work, and assisting in raids in the gambling and narcotics f Deputy marshals are also performing surveillance and undercover work fo Department of Justice in areas where it is anticipated disturbances or non pliance with court orders may occur.

It was necessary to request additional funds last year to cover the cost ( emergency situation which arose in a Southern State (Meredith case) w necessitated furnishing a large force of deputies to enforce a court orde similar emergency arose in another Southern State late in the fiscal: Deputy marshal guard details were maintained in both States.

Recently the Civil Service Commission authorized the reclassification of tain senior field deputy positions from GS-7 to GS-8. It is estimated that positions will be affected and the annual cost of the upgrading will aggre $100,000.

As previously explained in the justifications for additional furniture al ances for the U.S. attorneys' offices the General Services Administration supplied the Department with the proposed completion schedule of new Fec buildings throughout the country for the fiscal years 1965 through 1968. estimated cost of furniture and equipment for both the U.S. attorneys' marshals' offices for this period will aggregate $528,600. The marshals' s of this cost is $50,000 annually or $14,100 more than the amount curre available.

The Executive Office for U.S. Marshals is promoting better utilization of power and more efficient management and business administration through executive development program. Conferences of U.S. marshals are planned an annual basis, in addition to personal conferences, when necessary, to res local problems. The national training program, conducted by service person involves training courses for chief deputy marshals and deputy marshals. T course are essential in order to apprise new deputy marshals of their resp bilities and duties as well as Department policies and regulations. Refre courses are held when possible for chief deputy marshals and regular de marshals. At the local level, U.S. marshals are encouraged to conduct in-dis training programs.
