R. 57641 The Committee on Public Lands, to whom was referred the bill (H. R. 5764) to authorize the granting to the city of Los Angeles, Calif., of rights-of-way on, over, under, through, and across certain public lands, having considered the same, report favorably thereon with amendments and recommend that the bill do pass. The amendments are as follows: Page 15, line 2, insert comma after word "point". EXPLANATION OF THE BILL The purpose of this bill is to grant to the city of Los Angeles permanent rights-of-way 250 feet wide over public domain lands in the counties of Mono, Inyo, and Kern in the State of California. Said rights-of-way to be used only for the generation, transformation, transmission, distribution, and utilization of electrical energy by the city and would not affect valid existing rights. The lands would remain subject to the mining laws, the mineral leasing laws, and nonmineral public-land laws, subject to the rights-of-way granted to the city. Adequate protection of the public interest is afforded by provisions authorizing the Secretary of the Interior and the Secretary of Agriculture to impose necessary conditions. The city is to pay a reasonable charge or the use of these public lands. According to testimony given before the committee there is no controversy with respect to this bill. The Department of the Interior the city of Los Angeles, the counties of Mono, Inyo, and Kern are in agreement. R. 5764, a bill to authorize the granting to the city of Los Angeles, Calif., of rights-of-way on, over, under, through, and across certain public lands. I have no objection to the enactment of the bill H R. 5764 would authorize the Secretary of the Interior, in his discretion, and under such regulations as may be promulgated by the Secretary of the Interior or Agriculture, as the case may be. to grant to the city of Los Angeles permanent rights-of-way 250 feet in width over certain public lands in the counties of Mono, Inyo. and Kern in the State of California. Such rights-of-way would be used only for the generation, transformation, transmission, distribution, and utilization of electrical energy by the city and would not affect valid existing rights. The lands covered would remain subject to the mining laws, the mineral leasing laws, and nonmineral public land laws, subject to the rights-of-way granted to the city by the Secretary of the Interior under the act. The city of Los Angeles was granted rights-of-way under the act of June 23, 1936 (49 Stat. 1892), but that act affects lands only in Mono County. It appears that only a small portion of the rights-of-way now sought under the bill are within Mono County. The right-of-way is largely in Kern and Inyo Counties. There has been considerable public controversy with respect to grants to the city of Los Angeles in Mono and Inyo Counties. and the House Public Lands Committee, in the Eightieth Congress, reported out favorably a bill, H. R. 6697, to settle the problem (H. Rept. No. 2429, to accompany H. R. 6697, June 19, 1948). H. R. 5764 is no attempt to settle that controversy. The bill affects, primarily, other lands. This Department does not know of any controversy with respect to this bill. I know of no reason to object to the enactment of the bill. Adequate protection of the public interest is afforded by provisions authorizing the Secretary of the Interior and the Secretary of Agriculture to impose necessary conditions. Under this provision, it is contemplated that the city would be required to pay a reasonable charge for the use of the public lands, and to comply with such other rules and regulations as appertain to the use of public lands for the purposes stated in the bill. Field investigations are now going or as to the availability of the various lands affected by the bill for right-of-way purposes. In view of the broad discretion vested in the Department under the bill, there appears to be no reason to delay action on the bill awaiting the receipt of complete reports on the lands. If there is any reason to refuse the grant of a particular right-of-way, this Department may do so under the bill. Since I understand an immediate hearing may be held by your committee on H. R. 5764, this report has not yet been submitted to the Bureau of the Budget. I am, therefore, unable to advise you, at present, concerning its relationship to the program of the President.
