AN ACT

To permit the Smithsonian Gallery of Art Commission to purchase a model of the winning design for the proposed Smithsonian Gallery of Art, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) the Smithsonian Gallery of Art Commission is authorized to purchase, at a price not to exceed $2,500, from Eliel Saarinen, Eero Saarinen, and Robert F. Swanson, a model of their winning design furnished in competition for a design for the proposed Smithsonian Gallery of Art.

(b) Said Commission is further authorized to pay the sum of $800 to Joseph_Hudnut and the sum of $700 to Thomas D. Mabry, Junior, as final payments to said persons for services rendered as consultants in connection with the competition for a design for the Smithsonian Gallery of Art.

SEC. 2. There is hereby reappropriated, out of the unexpended balance of the amount appropriated in the Second Deficiency Appropriation Act, approved June 25, 1938, under the heading "Independent establishments", subheading "Smithsonian Institution", the sum of $2,500 to carry out the provisions of subsection (a) of section 1; and the sum of $1,500 is hereby made immediately available out of such unexpended balance to carry out the provisions of subsection (b) of section 1.

AN ACT

To amend an Act entitled "An Act to authorize the Secretary of War to proceed with the construction of certain public works in connection with the War Department in the District of Columbia", approved June 15, 1938.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Act entitled "An Act to authorize the Secretary of War to proceed with the construction of certain public works in connection with the War Department in the District of Columbia", approved June 15, 1938, is hereby amended to read as follows: "That the Secretary of War is hereby authorized to construct in the District of Columbia a building with the utilities, accessories, and appurtenances thereto to replace the present Army Medical Library and Museum Building now located in the District of Columbia, and to acquire by purchase, condemnation, or otherwise a suitable site: Provided, That the location and design of such building shall be subject to the approval of the National Capital Park and Planning Commission: Provided further, That the total cost of the construction and acquisition of a suitable site hereby authorized shall not exceed the sum of $4,750,000."

AN ACT

To increase the amount authorized by the Act of July 11, 1940, for the construction of a building for the office of the recorder of deeds of the District of Columbia.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 1 of the Act entitled "An Act authorizing advancements from the Federal Emergency Administration of Public Works for the construction of a recorder of deeds building in the District of Columbia, and for other purposes", approved July 11, 1940, is amended by striking out "the sum of $450,000," and inserting in lieu thereof "the sum of $500,000,".

AN ACT

To authorize the Federal Security Administrator to accept gifts for Saint Elizabeths Hospital and to provide for the administration of such gifts.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Federal Security Administrator is authorized to accept on behalf of the United States gifts made unconditionally by will or otherwise for the improvement, maintenance, or operation of Saint Elizabeths Hospital in the District of Columbia. Conditional gifts may be so accepted if recommended by the Surgeon General of the Public Health Service, and the principal of and income from any such conditional gift shall be held, invested, reinvested, and used in accordance with its conditions, but no gift shall be accepted which is conditioned upon any expenditure not to be met therefrom or from the income thereof unless such expenditure has been approved by Act of Congress.

SEC. 2. Any unconditional gift of money accepted pursuant to the authority granted in section 1 of this Act, the net proceeds from the liquidation (pursuant to section 3 or section 4 of this Act) of any other property so accepted, and the proceeds of insurance on any such gift property not used for its restoration, shall be deposited in the Treasury of the United States and are hereby appropriated and shall be held in trust by the Secretary of the Treasury for the benefit of Saint Elizabeths Hospital, and he may invest and reinvest such funds in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States. The income from such investments shall be available for expenditure in the improvement, maintenance, or operation of Saint Elizabeths Hospital, subject to the same examination and audit as provided for appropriations made for Saint Elizabeths Hospital by Congress.

SEC. 3. The evidences of any unconditional gift of intangible personal property, other than money, accepted pursuant to the authority granted in section 1 of this Act shall be deposited with the Secretary of the Treasury and he, in his discretion, may hold them or may liquidate them whenever in his judgment the purposes of the gifts will be served thereby. The income from any such property held by the Secretary of the Treasury shall be available for expenditure as is provided in section 2 of this Act.

SEC. 4. The Federal Security Administrator shall hold any real property or any tangible personal property accepted unconditionally pursuant to the authority granted in section 1 of this Act and he shall permit such property to be used for the improvement, maintenance, or operation of Saint Elizabeths Hospital or he may lease or hire such property, and may insure such property, and deposit

the income thereof with the Secretary of the Treasury to be available for expenditure as provided in section 2 of this Act: Provided, That the income from any such real property or tangible personal property shall be available for expenditure in the discretion of the Federal Security Administrator for the maintenance, preservation, or repair and insurance of such property and that any proceeds from insurance may be used to restore the property insured. Any such property when not required for the improvement or operation of the Saint Elizabeths Hospital may be liquidated by the Federal Security Administrator whenever in his judgment the purposes of the gifts, will be served thereby.

AN ACT

To authorize the renewal of the lease of the old naval hospital in the District of Columbia for an additional period of fifteen years.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Navy be, and he is hereby, authorized to lease the old naval hospital property, Washington, District of Columbia, bounded by Pennsylvania Avenue, E Street, Ninth Street, and Tenth Street, Southeast, to the Board of Management of the Temporary Home for Soldiers and Sailors, for the purpose of a temporary home for ex-soldiers and sailors, for a period of fifteen years, upon the same terms and conditions as those existing in the present lease, notwithstanding the provisions of the Act of August 29, 1916 (39 Stat. pp. 559-560): Provided, That when the said property shall cease to be used for said purposes said lease shall be automatically terminated and the said property shall revert to the full custody and control of the Navy Department.

SEC. 2. That the Secretary of the Navy be, and he is hereby, authorized to execute on behalf of the United States all instruments necessary to accomplish the aforesaid purposes.

JOINT RESOLUTION

Providing for the acceptance of title to the Widener art collection of Philadelphia, and for other purposes.

Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the faith of the United States is pledged that, upon acceptance for the Smithsonian Institution by the Trustees of the National Gallery of Art, in accordance with the provisions of the Act of March 24, 1937 (50 Stat. 51; U. S. C., title 20, secs. 71-75), of a collection of works of art as a gift effected by Joseph E. Widener, of Philadelphia, Pennsylvania, pursuant to the terms of the will of the late P. A. B. Widener, of Philadelphia, Pennsylvania, the United States will provide the National Gallery of Art with such funds as may be necessary for the payment of any taxes which may be levied as a result of the gift.

There is hereby authorized to be appropriated, out of any money in the Treasury not otherwise appropriated, such amount as may be necessary to carry out the provisions of this ioint resolution.
