4 SEC. 5. TRANSITION.

(1) INITIAL SELECTIONS.-The Secretary of De

fense shall make the initial selections of officers for the joint subspecialty from among officers in such grades as the Secretary determines.

(2) SPECIAL RULES.-In making such selections, the Secretary

(A) may waive the requirement of either clause (A) or (B) (but not both) of the last sen

tence of section 2(b)(2) in the case of officers in a

grade above captain or, in the case of the Navy,

lieutenant and below the grade of brigadier gener

al or rear admiral (lower half); and

(B) may waive the requirements of both clauses (A) and (B) of such sentence in the case of

general and flag officers who have served in joint

assignments.

(b) REQUIREMENT FOR SELECTION AS CINC.-Sec

23 tion 2(f) shall take effect on January 1, 1991.

(c) PROMOTION POLICY.-The amendments made by

25 section 3 shall take effect with respect to selection boards

-1 convened under section 611(a) of title 10, United States

To revise, reform, and standardize the organization of the executive part of the military departments, and for other purposes.

This Act may be cited as the "Military Department Re5 organization Act of 1986".

1 SEC. 2. REORGANIZATION OF MILITARY DEPARTMENTS BY

THE SECRETARY OF DEFENSE.

(a) IN GENERAL.-The Secretary of Defense shall reor

4 ganize the executive part of the military departments in ac

5 cordance with the provisions of this Act.

(b) REORGANIZATION POLICIES.-In carrying out the 7 reorganization required by subsection (a), the Secretary of

8 Defense shall implement the following policies:

(1) Each military department shall have a single integrated staff for the executive part of the department, rather than separate civilian secretariat and military staffs.

(2) Commissioned officers serving on the new military department staff shall not constitute or be organized as a separate component within the staff.

(3) There shall be uniformity of organization among the department staffs of the three military departments. The functional assignments of the assistant secretaries of the military departments, other senior civilian officials, and senior military officers on the department staffs shall be as uniform as possible across the military departments. In implementing this policy, the Secretary shall limit exceptions to the greatest

extent possible.

(4) Senior civilian officials on the department staff who are political appointees shall not be placed in a

position subordinate to a military officer.

(5) The size of the department staffs shall be substantially reduced from the combined size of the prior secretariat and military staffs, with functions to be shifted to appropriate joint staffs or to subordinate commands outside the seat of government.

(c) LIMITATION ON FUTURE ADMINISTRATIVE REOB10 GANIZATION OF THE MILITARY DEPARTMENTS.-After the 11 reorganization required by this section is implemented, no re12 organization may be made within the Department of Defense 13 that would be inconsistent with the policies set forth in sub14 section (b).

15 SEC. 3. EXECUTIVE PART OF MILITARY DEPARTMENTS.

(a) IN GENERAL.-The executive part of each of the

17 military departments is composed of the following:

(1) The Secretary of the military department.

(2) The Under Secretary.

(3) The Assistant Secretaries.

(4) The general counsel.

(5) The Chief of Staff or, in the case of the De

partment of the Navy, the Chief of Naval Operations

and the Commandant of the Marine Corps.
