paragraph 6, of the Dumbarton Oaks Proposals be adopted by Commission II in the following amended form:

6. The General Assembly should initiate studies and make recommendations for the purpose of promoting international cooperation in political, economic, social, cultural, educational, and health fields to assist in the realization of human rights and basic freedoms for all without distinction as to race, language, religion, or sex and also for the encouragement of the progressive development of international law and for its codification.

(New paragraph to follow paragraph 6)

7. Subject to the provisions of paragraph 1 of this Section, the General Assembly should be empowered to recommend measures for the peaceful adjustment of any situations, regardless of origin, which it deems likely to impair the general welfare or friendly relations among nations, including situations resulting from a violation of the Purposes and Principles set forth in this Charter.

Recommendation 4. It is recommended that Chapter V, Section B, paragraph 8, of the Dumbarton Oaks Proposals be adopted by Commission II in the following amended form:

8. The General Assembly should receive and consider annual and special reports from the Security Council; such reports should include an account of the measures which the Security Council has adopted or applied to maintain international peace and security.

The General Assembly should receive and consider reports from the other bodies of the Organization.

First Report of Drafting Subcommittee II/3/A to

Committee II/3

The Drafting Subcommittee met in Room 311, Veterans Building, on May 15 at 2:30 p.m. to consider amendments to Chapter IX, Section A, paragraph 1, of the Dumbarton Oaks Proposals. It recommends that the paragraph, excluding the last sentence, be redrafted to read as follows:

With a view to the creation of conditions of stability and well-being which are necessary for peaceful and friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, the Organization shall promote

a. higher standards of living, high and stable levels of employment (full employment), and conditions of economic and social progress and development; b. solutions of economic, social, cultural," health, and other related problems; and c. universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to race, language, religion, or sex.

Third Report of Drafting Subcommittee II/3/A to Committee II/3

(This report supersedes the second report)

The Drafting Subcommittee met at 3:30 p.m. on May 18, at 10:15 a.m. and 3 p.m. on May 19, at 9:45 a.m. on May 21, and at 9:45 a.m. on May 22. It makes the following recommendations:

1. Chapter IX, Section C, 1

This Section should be redrafted to read as follows:

SECTION C. FUNCTIONS AND POWERS OF THE ECONOMIC AND SOCIAL COUNCIL The Economic and Social Council shall be empowered:

(a) to carry out, within the scope of its functions, recommendations of the General Assembly;

(b) to make recommendations, on its own initiative, for promoting respect for, and observance of, human rights and fundamental freedoms;

(c) to make and to initiate studies and reports with respect to international economic, social, cultural, health, and other related matters, and to make recommendations, on its own initiative, on such matters to the General Assembly, to the members of the Organization, and to specialized organizations or agencies concerned;

(d) to coordinate the activities of the economic, social, cultural, health, and other specialized organizations or agencies brought into relation with the

Organization, through consultation with, and recommendations to, such organizations or agencies, and through recommendations to the General Assembly and to the members of the Organization;

(e) to obtain regular reports from the specialized organizations or agencies; to obtain reports from the members of the Organization and from the specialized organizations or agencies on the steps taken to give effect to its own recommendations and to those of the General Assembly; and to communicate its observations on such reports to the General Assembly;

(f) to perform services at the request of members of the Organization and at the request of specialized organizations or agencies with respect to economic, social, cultural, health, and other related matters, subject to the approval of the General Assembly;

(g) to call, in accordance with the rules prescribed by the Organization, international conferences on matters falling within the scope of the functions of the Council;

(h) to furnish information to the Security Council;

(i) to assist the Security Council upon its request ; and

(j) to perform such other functions within the general scope of its competence as may be assigned to it by the General Assembly.

The Subcommittee has agreed to give further consideration to an additional proposed paragraph not included above. Also, the Subcommittee may wish to reconsider the order of the paragraphs in Section C.

The Subcommittee wishes to point out that the phrase "the members of the Organization" occurring in subparagraphs (c), (d), and (e) above should be translated into languages other than English in such a way as to indicate clearly that it means all the members of the Organization.

2. Chapter V, Section B, 7

The amendment of the four sponsoring powers should be adopted as paragraph 7 (1). The words, "cultural, health," should be added after the word, "social," in paragraph 7.

The Subcommittee recommends, in this connection, that Committee II/1 be asked to consider whether the provisions of V, B, 5, are broad enough to cover the variety of financial and budgetary arrangements which it may be necessary to make with existing and future specialized agencies.

3. Chapter IX, Section A

The following new paragraph should be added after paragraph 1:

1 (1) All members pledge themselves to take separate and joint action and to cooperate with the Organization and with each other to achieve these purposes.

The Subcommittee wishes to reserve the right to consider the arrangement of the whole of Chapter IX at a later stage of its work.

Fourth Report of Drafting Subcommittee II/3/A to Committee II/3

The Drafting Subcommittee met at 10:30 a.m. on May 23. It makes the following recommendations:

1. Chapter IX, Section B

This section should be redrafted to read as follows:

SECTION B: COMPOSITION AND VOTING

The Economic and Social Council shall consist of representatives of 18 members of the Organization. The states to be represented for this purpose shall be elected by the General Assembly. The term of service of the members shall be three years, but arrangements shall be made after the first election for six of the members, elected at that election, to retire after one year, and six after two years. Members shall be eligible for reelection at any time. Each member shall have one representative who shall have one vote. Decisions of the Economic and Social Council shall be taken by simple majority of those present and voting.

The Subcommittee recommends that the arrangements referred to in IX, B, should be as follows: All 18 members initially elected to the Economic and Social Council should be elected on the same basis. It would then be determined by drawing lots which six members should retire after one year and which six after two years. The Subcommittee considers that this method would be preferable to any method whereby members were elected either for one-year or two-year terms or any method whereby retirements would be determined according to the number of votes received by the members. Under both these latter methods it would be very likely that the important countries which should remain on the Council would all retire and come up for reelection at once.

2. Chapter V, Section B, 6

This paragraph should be redrafted to read as follows:

6. The General Assembly shall initiate studies and make recommendations for the purpose of promoting international cooperation in the political, economic, social, cultural, and health fields, assisting in the realization of human rights and basic freedoms for all, without distinction as to race, language, religion, or sex, and encouraging the development of international law.

Fifth Report of Drafting Subcommittee II/3/A to Committee II/3

The Drafting Subcommittee met at 3 p.m. on May 24, 10:30 a.m. on May 25, and 3 p.m. on May 26. It makes the following recommendations:

1. Chapter IX, Section A, paragraph 1

a. The last sentence of paragraph 1 should read as follows:

Responsibility for the discharge of this function shall be vested in the General Assembly and, under the authority of the General Assembly, in the Economic and Social Council.

b. Subparagraph b of paragraph 1, as approved by the Committee in Document 381 (Summary Report of Seventh Meeting of Committee II/3), should be amended to read as follows:

b. Solutions of international economic, social, health, and other related problems; international cultural and educational cooperation; and

The Subcommittee wishes to make the following comments on subparagraph b for the records of the Committee:

1. The Subcommittee understands that the language of subparagraph b includes international cooperation in the suppression of traffic in, and abuse of, opium and other narcotics and dangerous drugs.

2. The Subcommittee wishes to emphasize that the "economic" field is similarly comprehensive and includes, for instance, international trade, finance, and communications and transport.

2. Chapter IX, Section A, paragraph 2

a. The following new paragraph 2 (1) should be added:

The Organization shall, where appropriate, initiate negotiations among the nations concerned for the creation of any specialized organization or agency required for the accomplishment of the purposes set out above.

b. The Subcommittee recommends that there be no mention of the creation of any specialized organization to deal with questions such as access to raw materials, raised by some delegations, or the cognate questions of access to capital goods, raised by others. It feels that it would be misleading to mention one or two important fields and not to mention others.

3. Chapter V, Section B, paragraph 5

Four members of the Subcommittee met with a subcommittee of Committee II/1 to consider the recommendation of the Committee that the scope of the paragraph be enlarged. The following draft was prepared, and subsequently accepted unanimously by Committee II/1:

The General Assembly shall apportion the expenses among the members of the Organization. It shall consider and approve the budgets of the Organization as well as any financial and budgetary arrangements with specialized agencies brought into relationship with the Organization under the provisions of Chapter IX, Section A, paragraph 2.

Sixth Report of Drafting Subcommittee II/3/A to

Committee II/3

The Drafting Subcommittee met at 3 p.m. on Monday, May 28. It makes the following recommendations:

1. Chapter IX, Section A, paragraph 1(1)

Paragraph 1(1) should be redrafted to read as follows:

All members undertake to cooperate jointly and severally with the Organization for the achievement of these purposes.

The Chairman ruled that this redraft was in full accordance with the paragraph that the Committee had accepted in principle at its twelfth meeting.

2. Chapter IX, Section A, paragraph 2

This paragraph should be redrafted to read as follows:

The various specialized intergovernmental organizations and agencies having wide international responsibilities in economic, social, and other related fields, as defined in their basic instruments, shall be brought into relationship with the Organization on terms to be determined by agreement between the Economic and Social Council and the appropriate authorities of the specialized organizations or agencies, subject to approval by the General Assembly. Such agreements shall be initiated by the Economic and Social Council.

The Subcommittee still has under consideration two proposed additions to this paragraph.
