3 1 operate and coordinate their activities to effectively carry 2 out the objective of this Act. 3 4 TITLE II-INITIAL STAGE SEC. 201. In conformity with sections 102 (b) and 102 5 (c) of this Act, the Secretary is authorized to construct the 6 following salinity control units as the initial stage of the 7 Colorado River Basin Salinity Control Program: La Verkin 8 Springs, Paradox Valley, and Grand Valley. 9 10 11 TITLE III-CONTINUING PROGRAM SEC. 301. The Secretary is authorized and directed to: (a) Expedite completion of the planning reports on 12 the following units, of which (1) through (3) are described 13 in the Secretary's report, "Colorado River Water Quality 14 Improvement Program, February 1972." 7 4 San Rafael River; Dirty Devil River; McElmo Creek; and Big Sandy River. (4) Saline water collection system of Las Vegas Wash. (b) Submit each planning report on the units named 8 in section 301 (a) of this Act promptly to the Colorado 9 River Basin States and to such other parties as the Secre10 tary deems appropriate for their review and comments. After 11 receipt of comments on a unit and careful consideration 12 thereof, the Secretary shall submit each final report with his 13 recommendations to the President, other concerned Federal 14 departments and agencies, the Congress, and the Colorado 15 River Basin States. 16 SEC. 302. The Secretary is directed: 17 (a) In the investigation, planning, construction, and 18 implementation of any salinity control unit involving control 19 of salinity from irrigation sources, to cooperate with the Sec20 retary of Agriculture in carrying out research and demon21 stration projects and in implementing on-the-farm improve22 ments and farm management practices and programs which 23 will further the objective of this Act. 24 (b) To undertake research on additional methods for 25 accomplishing the objective of this Act, utilizing to the fullest 5 1 extent practicable the capabilities and resources of other 2 Federal departments and agencies, interstate institutions, 3 States, and private organizations. 4 5 TITLE IV-ADVISORY COUNCIL SEC. 401. (a) There is hereby created the Colorado 6 River Basin Salinity Control Advisory Council composed of 7 no more than three members from each State appointed by 8 the Governor of each of the Colorado River Basin States. 9 10 11 12 13 31 14 15 16 17 18 19 20 (b) The Council shall be advisory only and shall: (2) receive reports from the Secretary on the progress of the salinity control program and review and comment on said reports; and (3) recommend to both the Secretary and the Administrator of the Environmental Protection Agency appropriate studies of further projects, techniques, or methods for accomplishing the purposes of this Act. 21 TITLE V-ALLOCATION OF COSTS, REPAYMENTS SEC. 501. The Secretary shall allocate the total costs of each unit or separable feature thereof authorized by section 24 201 of this Act, as follows: 6 1. (a) In recognition of Federal responsibility for the Col2 orado River as an interstate stream and for international 1 3 comity with Mexico, Federal ownership of the lands of the 4 Colorado River Basin from which most of the dissolved salts 5 originate, and the policy embodied in the Federal Water 6 Pollution Control Act Amendments of 1972 (86 Stat. 816), 7 75 per centum of the total costs of construction, operation, 8 mantenance, and replacement of each unit or separable fea9 ture thereof shall be nonreimbursable. 10 (b) Twenty-five per centum of the total costs shall be 11 allocated between the Upper Colorado River Basin Fund 12 established by section 5 (a) of the Colorado River Storage 13 Project Act (70 Stat. 107) and the Lower Colorado River 14 Basin Development Fund established by section 403 (a) of 15 the Colorado River Basin Project Act (82 Stat. 895) after 16 consultation with the Advisory Council created in section 17 401 (a) of this Act and consideration of the following items: (1) benefits to be derived in each basin from the use of water of improved quality and the use of works 18 19 20 21 223 *23 24 25 for improved water management; (2) causes of salinity; and (3) availability of revenues in the Lower Colorado River Basin Development Fund and increased revenues to the Upper Colorado River Basin Fund made avail able under section 504 of this Act: Provided, That costs i 2 3 4 5 6 allocated to the Upper Colorado River Basin Fund under section 501 (b) of this Act shall not exceed 15 per centum of the costs allocated to the Upper Colorado River Basin Fund and the Lower Colorado River Basin Development Fund. (c) Costs of construction of each unit or separable fea7 ture thereof allocated to the upper basin and to the lower 8 basin under section 501 (b) of this Act shall be repaid 9 within a fifty-year period without interest from the date such 10 unit or separable feature thereof is determined by the Secre11 tary to be in operation. 12 SEC. 502. (a) Costs of construction, operation, mainte13 nance, and replacement of each unit or separable feature 14 thereof allocated for repayment by the lower basin under sec15 tion 501 (b) of this Act shall be paid in accordance with 16 subsection (b) of this section, from the Lower Colorado 17 River Basin Development Fund. 18 (b) Section 403 (g) of the Colorado River Basin Proj19 ect Act (82 Stat. 896) is hereby amended as follows: strike 20 the word "and" after the word "Act" in line 8; insert after 21 the word "Act" the following: "(2) for repayment to the 22 general fund of the Treasury the costs of each salinity con23 trol unit or separable feature thereof payable from the Lower 24 Colorado River Basin Development Fund in accordance with 25 Sections 501 (b), 501(c), and 502 (a) of the Colorado |
